Personal / Sensitive Information

Personal / sensitive information is any information or opinion (whether true or not) concerning you. This may range from the very sensitive (e.g. medical history or condition, criminal record, disability) to the routine (e.g. address and phone number). It includes the opinions of others regarding your work performance (whether true or not), your work experience and qualifications, psychometric assessment results and other information obtained by us in connection with your possible work placements. In accordance with other laws such as Anti-Discrimination and EEO, Mitchell Morley Employment Solutions and Mitchell Morley Employees (mme) will only seek to collect personal / sensitive information if, in our view, it is necessary for business purposes and for the inherent requirements of the position. Personal/sensitive information can only be disclosed with your consent.

Who collects your personal and sensitive information?

Your personal / sensitive information will be collected by mme for its own use and on behalf of clients who might require access to this information in connection with your work placements. This information may contribute to an assessment report. Assessment reports are managed as confidential documents and are only accessible by mme and our client organizations that have a reasonable need to know. In all cases mme will ensure that we collect accurate, complete, up to date and relevant information.

How is your information collected?

Personal / sensitive information will be collected from you directly when you complete our registration form or any other information in connection with your application for registration. When we obtain information directly from an individual we will advise of the reason for the information being collected, to whom the information will be given, how the information may be accessed and if charges will apply. Personal / sensitive information will also be collected when we receive:

  • Any reference about you;
  • Results of inquiries that we might make of your former employers, work colleagues, professional associations or registration body;
  • The results of any competency, psychometric or medical test;
  • Performance feedback (whether positive or negative);
  • Any complaint from or about you in the workplace;
  • Any information about a workplace accident in which you are involved;
  • Any information about a harassment or discrimination incident in which you are involved;
  • Any information about any insurance investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you are involved;
  • Any additional information for payroll purposes, e.g. banking details, tax file number.

General information collected from visitors to our website We gather information about all our website users collectively, such as what areas users visit more frequently and what services users access the most. We only use such data anonymously and in the aggregate. This information helps us determine what is most beneficial for our users, and how we can continually create a better overall website experience for you.

Your personal information collected on the mitchellmorley.com.au and mmegroup.com.au websites In some instances we may need specific information about you, such as name, address, email address, telephone number etc. We will collect this information if you apply for a job or sign up for a service via our website. We may also ask you for other information such as the types of jobs you are interested in and your workplace concerns in order to provide you with the best possible service and internet experience.

How is your information used?

Your personal / sensitive information may be used in connection with:

  • Any actual or possible work placement;
  • Providing reference check information to prospective employers;
  • Performance appraisals;
  • Our assessment of your ongoing performance;
  • Any test or assessment (including medical tests and assessments) that you might be required to undergo;
  • Any workplace rehabilitation;
  • Our management of any complaint, investigation or inquiry in which you are involved;
  • Any insurance claim or proposal that requires disclosure of your personal / sensitive or sensitive information;
  • On-going payroll management.

Disclosure of personal / sensitive information

mme will only use and disclose personal information about an individual for the intended or related purpose, unless it is considered that information may be relevant to the health and safety of the individual or for law related purposes. Your personal / sensitive information may be disclosed to:

  • Potential and actual employers and clients of mme;
  • Referees
  • Our insurers;
  • A professional association or registration body that has a proper interest in the disclosure of your personal / sensitive information;
  • A Workers Compensation body;
  • Our contractors and suppliers – e.g. our I.T. contractors and database designers;
  • Any person with a lawful entitlement to obtain the information.

Non provision of information

If you do not give us the information we seek we may be limited in our ability to place you in employment.

Access to and Correction of your information

Subject to some exceptions which are set out in the National Privacy Principles (Principle 6 Access and Correction) of the Privacy Amendment (Private Sector) Act 2000, you have a right to view and receive a copy of personal and sensitive information about you held by mme. If you are able to establish that personal information that we hold about you is inaccurate, incomplete or out of date, we will take reasonable steps to correct it so that it is accurate, complete and up-to-date. If we are unable to agree that personal information that we hold about you is accurate, complete and up-to-date, you may ask us to place with the information a statement by you that claims that particular information is inaccurate, incomplete or out of date. Individuals will be given reasonable access to feedback after the selection decision is known and upon establishing their identity as the individual assessed.

Storage

mme will store your personal / sensitive information for a reasonable period of time necessary to provide you with our services. At any time you may request to have your personal / sensitive information destroyed. Personal / sensitive information will be destroyed or permanently de-identified when no longer needed for any purpose for which the information was intended or for any legal holding periods. We will do this for any lawful request
